Personal Injury & Accident Lawyers in Korat
Fair compensation after an accident or injury
If you have been injured through someone else's fault — on the road, at work, or otherwise — you may be entitled to compensation. We handle the evidence and the insurers so you can focus on recovery.
What does a personal injury lawyer in Korat do?
A personal injury lawyer in Korat (Nakhon Ratchasima) claims compensation for you from the person at fault, and their insurer, after a road, workplace or other accident — covering medical costs, lost income and non-financial damage under Thailand's Civil and Commercial Code. In most cases the claim must be brought within one year of learning of the injury and who caused it.
Key facts
- 1 year from learning of the injury and who is liable, or 10 years from the act, to claim for a wrongful act. (Source: Civil and Commercial Code, s. 448)
- Recoverable heads of loss: expenses, present and future loss of ability to work, and non-pecuniary damage. (Source: Civil and Commercial Code, ss. 444 & 446)
- Compulsory motor insurance (Por Ror Bor) pays preliminary compensation without proof of fault: up to 30,000 baht for medical costs and 35,000 baht for death or disability, per person. (Source: Compulsory motor insurance policy terms (Chubb Samaggi))
- Once fault is established, the same cover pays up to 80,000 baht for injury and 500,000 baht for death or total permanent disability, per person. (Source: Compulsory motor insurance policy terms (Chubb Samaggi))
What compensation can you claim for an injury in Thailand?
Section 444 of the Civil and Commercial Code lets the injured person recover their expenses and damages for total or partial loss of ability to work, now and in the future. Section 446 adds compensation for non-pecuniary damage such as pain and suffering.
How long do you have to file an injury claim in Thailand?
Under Section 448, a claim for a wrongful act expires one year from the day the injured person knew of the act and of the person liable, or ten years from the act itself — whichever comes first. A longer period can apply where the act is also a crime with a longer prescription.
Do you need a lawyer near you after a road accident?
Compulsory motor insurance pays a limited preliminary amount without proof of fault, but full damages usually depend on proving fault and negotiating with the insurer. A local lawyer can collect the police report and medical records in Korat and bring the case in the local courts if the insurer's offer is too low.
